Agreement
Introduction
Welcome to Zen Autos Ghana. These Terms of Service ("Terms") govern your access to and use of the Zen Autos website (zenautos.co), mobile applications, and any related services (collectively, the "Services") provided by Zen Autos Ghana ("Zen Autos," "we," "us," or "our").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services. We recommend that you read these Terms carefully before placing an order, making a deposit, or entering into any agreement with us.
These Terms apply to all users of the Services, including browsers, customers, and vendors. Zen Autos reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Services following any changes constitutes your acceptance of the revised Terms.
Key Terms
Definitions
Zen Certified
A vehicle that has passed our 280-point inspection, disclosed full VIN history, and meets our quality standards.
Cash Buyout
A purchase method where the customer pays a 20% non-refundable deposit at order, and the remaining balance within 5 days of the vehicle arriving in Accra.
Lease-to-Own
A financing arrangement where the customer pays a 20% down payment, then makes daily, weekly, or monthly payments over a term of 6 to 48 months. Full ownership transfers upon the final payment.
Zen Care
An optional add-on package ($1,500 / GHS 18,000) that extends the standard warranty and scheduled maintenance by one year, to 15,000 km.
DVLA
The Driver and Vehicle Licensing Authority of Ghana, responsible for vehicle registration and licensing.
Deposit
The 20% payment required at the time of order, which is non-refundable except as expressly stated in these Terms.
Who Can Use Our Services
Eligibility
To use our Services and enter into a purchase or lease agreement, you must:
- 1.Be at least 18 years of age and legally capable of entering into a binding contract.
- 2.Possess a valid form of government-issued identification (Ghana Card, passport, or driver's license).
- 3.Provide accurate and complete personal and financial information as requested during the order process.
- 4.For lease-to-own customers, demonstrate a verifiable source of income sufficient to meet the payment schedule.
Zen Autos reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion if we determine that you do not meet these eligibility requirements or have provided false or misleading information.
Placing an Order
Vehicle Orders & Deposits
All vehicle orders are subject to acceptance by Zen Autos. An order is confirmed only when we issue a written order confirmation and receipt of your deposit payment.
Deposit Requirement
A non-refundable deposit of 20% of the total vehicle price is required at the time of order for both Cash Buyout and Lease-to-Own purchases. This deposit secures your vehicle and initiates the sourcing, inspection, and shipping process.
Order Timeline
The typical delivery timeline is 6 to 10 weeks from order confirmation. This timeline includes vehicle sourcing, 280-point inspection, shipping to Tema Port, customs clearance, DVLA registration, and pre-delivery preparation. Timelines are estimates and may vary due to factors beyond our control, including shipping delays, customs processing, or force majeure events.
Price Changes
Vehicle prices are quoted in US Dollars (USD) and are subject to change without notice. However, once your order is confirmed and deposit is received, the price is locked and will not change for that order.
Payment
Pricing & Payment
Cash Buyout Payment
Cash buyers must pay the remaining 80% balance within 5 business days of the vehicle arriving in Accra. Full payment must be cleared before the vehicle is released for handover. Accepted payment methods include bank transfer, mobile money, and other methods as agreed upon at the time of order.
Lease-to-Own Payment
Lease customers choose a payment frequency at signing — daily, weekly, or monthly — over a term of 6, 12, 24, 36, or 48 months. Payments begin on the agreed start date after vehicle delivery. You may change your billing cycle at any time with 30 days' written notice. Extra payments and early payoff are permitted at any time with no penalty. Full ownership transfers to you upon the final scheduled payment.
Late Payments (Lease)
A 3-day grace period applies to all lease payments. After the grace period, a late fee of 2% per week is applied to the overdue balance. If a payment is more than 60 days overdue, Zen Autos reserves the right to initiate repossession proceedings. We encourage you to contact us early if you anticipate difficulty making a payment — we will work with you to find a solution.
Currency & Exchange Rates
All vehicle prices are listed in US Dollars (USD). Payments in Ghanaian Cedis (GHS) are accepted at the prevailing exchange rate on the date of payment. Zen Autos is not responsible for exchange rate fluctuations between the order date and payment date.
Getting Your Vehicle
Delivery & Registration
Zen Autos handles the full delivery process on your behalf:
All customs duties, taxes, and registration fees are included in the vehicle price quoted at the time of order. You will receive your vehicle fully registered, with DVLA number plates and documentation, ready to drive.
Coverage
Warranty & Maintenance
Standard Warranty (All Vehicles)
Every Zen Certified vehicle includes a 3-month / 10,000 km warranty covering the engine, transmission, and drivetrain. This warranty begins on the date of vehicle handover. Warranty claims are subject to inspection and must not result from misuse, neglect, unauthorized modifications, or failure to follow recommended maintenance schedules.
Scheduled Maintenance (Lease Customers)
Lease-to-Own customers receive 6 months of scheduled maintenance at no additional cost. This includes oil changes, oil filter replacement, air filter replacement, and scheduled service inspections at our Accra facility. Maintenance must be performed at Zen Autos or an authorized service partner to remain valid.
Zen Care Package (Optional)
The Zen Care package is available to any buyer or lessee for $1,500 (GHS 18,000). It extends both the warranty and scheduled maintenance coverage by one year, to 15,000 km. Zen Care must be purchased at the time of order and cannot be added after vehicle delivery. Zen Care includes all standard warranty coverage plus scheduled maintenance for the extended period, with no deductible.
Warranty Exclusions
The warranty does not cover normal wear-and-tear items including tires, brake pads, wiper blades, and fluids. Damage resulting from accidents, improper use, lack of maintenance, or unauthorized repairs is also excluded. Battery degradation in PHEV and EV models is covered under the manufacturer's battery warranty terms, not the Zen Autos standard warranty.
Quality Assurance
Vehicle Condition & Inspection
Every Zen Certified vehicle undergoes a comprehensive 280-point inspection covering:
A complete inspection report, full VIN history pulled from the origin market's database, and a condition report are provided to you before payment of the final balance. We do not sell vehicles with fire, flood, or major accident history. Mileage verification is included in the VIN history report.
Vehicles are sold in their inspected condition. Minor cosmetic imperfections consistent with the vehicle's age and mileage may be present and are documented in the condition report. You are encouraged to review all reports carefully before completing your purchase.
Changing Your Mind
Cancellation & Refunds
Deposit Refunds
All deposits (20% of vehicle price) are non-refundable once an order is confirmed. The deposit covers the costs of vehicle sourcing, inspection, and shipping preparation, which begin immediately upon order confirmation.
Cancellation by Zen Autos
If Zen Autos is unable to fulfill your order due to unavailability of the specified vehicle, failure to meet our quality standards during inspection, or other circumstances beyond our control, we will notify you promptly and provide a full refund of your deposit within 14 business days.
Lease Early Termination
Lease-to-Own customers may terminate their agreement at any time by returning the vehicle. In this case, all payments made to date are non-refundable. Alternatively, you may pay off the remaining balance at any time with no penalty and take full ownership of the vehicle.
Legal
Limitation of Liability
To the fullest extent permitted by applicable law, Zen Autos Ghana shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of our Services or any vehicle purchased through our Services.
Our total liability to you for any claim arising out of or relating to these Terms or any vehicle purchase shall not exceed the total amount paid by you to Zen Autos for the specific vehicle giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Ghanaian law.
Ownership
Intellectual Property
All content on the Zen Autos website and mobile applications, including but not limited to text, graphics, logos, images, videos, software, and the overall design and layout, is the exclusive property of Zen Autos Ghana or its content suppliers and is protected by Ghanaian and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from our Services without our prior written consent. The Zen Autos name, logo, and all related names, logos, and service marks are trademarks of Zen Autos Ghana.
Jurisdiction
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of Ghana.
We encourage you to contact us first to resolve any dispute informally before pursuing formal legal action. We are committed to addressing your concerns fairly and promptly.
